The Essential Services Commission has taken enforcement action against MYOM Australia Pty Ltd (MYOM) for allegedly breaching the Victorian Energy Upgrades (VEU) program rules.
Alleged breach
The commission alleges MYOM created Victorian energy efficiency certificates (certificates) for non-building based lighting using falsified photo evidence.
The commission investigated 180 of MYOM’s VEU energy efficiency activities after receiving a tip-off from the community about potential misconduct by MYOM.
The investigation identified that the same lights appeared in multiple photos submitted by MYOM as evidence of decommissioned lighting across multiple projects. The commission is not satisfied the certificates MYOM claimed were compliant.
Addressing conduct that compromises market integrity is a compliance and enforcement priority of the commission. This includes a focus on businesses that provide false information to the commission about VEU upgrades.
Our decision
We have restricted MYOM’s VEU accreditation, preventing them from undertaking non-building based lighting upgrades and creating certificates for this activity for six-months.
This puts an immediate stop to the alleged non-compliance so the commission can investigate all MYOM’s pending and registered certificates and consider additional enforcement action.
