We review and make decisions on applications for electricity and gas licences. We can also transfer, vary or revoke licences.
Electricity and gas licences
Overview
Anyone generating, transmitting, supplying or selling electricity, supplying gas or selling gas to retail customers in Victoria must hold a licence granted by us, or be exempt from this requirement.
When we grant an electricity or gas licence, we must consider our objectives, including the long-term interests of Victorian consumers in relation to the price, quality and reliability of energy supply.
We will not grant an application for a licence unless we are satisfied that the applicant has demonstrated:
- they are a fit and proper person to hold a licence
- has sufficient technical capacity to comply with their licence conditions, including the capacity to operate and manage the relevant business, and comply with the applicable regulatory requirements
- they are financially viable and have sufficient financial resources to establish a sustainable business able to satisfy the interests of consumers.
Applying for an electricity or gas licence
Offshore wind
Under current regulatory settings, an offshore wind provider that operates infrastructure generating electricity and delivery is connecting to a connection point within the transmission network, will need a generation licence from the commission.

Retail Licence Standard Conditions
On 12 September 2022, standard licence conditions for electricity retailers were consolidated into the ‘Standard Electricity Licence Conditions for Electricity Retail’, compliance with which is now a condition of a retail licence.

Electricity transmission licences
Electricity wholesale licences
Victorian electricity wholesale licences are no longer necessary.
In July 2024 an amendment was made to section 16(1) of the Electricity Industry Act 2000 by the National Energy Retail Law (Victoria) Act 2024. As a result, a person can now sell electricity through the wholesale electricity market without holding a licence authorising such a sale or being exempted or being the holder of a trial waiver.
In Victoria, twelve companies held licences to sell electricity through the wholesale electricity market.
All twelve companies agreed to revoke their licences on the basis that they are no longer necessary. The licences are revoked with effect from 30 June 2025.

Ministerial licence conditions
This page contains a list of Orders specifying Ministerial licence conditions published in the Government Gazette.
The minister can specify (vary or revoke) a condition to which a particular licence or specified class of licence is to be subject, by Order published in the Government Gazette. See section 33 AB(1) of the Electricity Industry Act 2000 and section 40A(1) of the Gas Industry Act 2001.
