Enforcement action against MYOM Australia Pty Ltd
1 May 2025
The commission has taken enforcement action against MYOM Australia Pty Ltd (trading as MYOM Australia) for allegedly breaching the Victorian Energy Upgrades (VEU) program rules.
Alleged breach
MYOM Australia allegedly breached the VEU program rules by creating Victorian energy efficiency certificates (certificates) for 250 non-building based lighting upgrades where the lighting designer did not hold a qualification required by the VEU program rules to prepare a lighting design.
Under the VEU program rules for non-building based lighting upgrades, lighting designers must hold an appropriate Illuminating Engineering Society of Australia and New Zealand qualification.
Since the alleged non-compliance, MYOM Australia has implemented changes to ensure it only uses qualified lighting designers in future non-building based lighting upgrades.
Our decision
We have:
- Refused registration of 22,792 pending certificates created for these lighting upgrades, valued at around $2.2 million (as at 1 May 2025).
- Formally warned MYOM Australia against future non-compliance and reminded them that they must ensure the compliance of anyone doing work for them or on their behalf, such as lighting designers.
Note: the certificate value on this page is based on the spot price of $95 as at 1 May 2025.
MYOM Australia was notified of this decision on 13 March 2025. The decision was subject to a 30 business day review period, which ended on 28 April 2025. MYOM Australia did not seek a review of the decision.
