The commission has taken enforcement action against accredited business Abigail Energy Pty Ltd (trading as 60 Shades) for allegedly breaching the Victorian Energy Upgrades (VEU) program rules.
Alleged breach
60 Shades allegedly breached the VEU program rules by creating non-compliant Victorian energy efficiency certificates for a household weather sealing upgrade. The certificates were not compliant, as the installer undertaking the activity failed to:
- obtain consumer consent for the upgrade and failing to provide them with information about who would do the upgrade
- meet weather sealing installation requirements.
60 Shades, as the accredited business, is responsible for making sure certificates they create and any installer acting on their behalf, comply with the VEU program rules.
Our decision
We have:
- Ordered the surrender of one non-compliant Victorian energy efficiency certificate created by 60 Shades for the upgrade, valued at around $100 (as at 8 May 2025).
- Warned 60 Shades against future non-compliance and reminded them that they must have adequate systems to monitor the compliance of anyone doing work on their behalf, such as installers.

60 Shades was notified of this decision on 21 March 2025. The decision was subject to a 30 business day review period, which ended on 7 May 2025. 60 Shades did not seek a review of the decision.
