In 2008 and 2009, the Essential Services Commission conducted audits of energy retailers, Simply Energy and AGL Energy. The audits reviewed the reliability and accuracy of selected performance indicators that are reported to the Commission, and compliance with other essential regulatory obligations. The audit report in June-July 2009 found significant non-compliance with the reliability and accuracy of performance indicators that Simply Energy reported to the Commission.
Simply Energy undertook a second audit of the performance indicators in September-October 2009 and this again found significant non-compliance. The Commission then sought, and Simply Energy provided, an administrative undertaking that it would remedy the deficiencies and underwent a further independent regulatory audit of the area by 30 April 2010.
