Some people or businesses who are exempt from our electricity licensing requirements may need to register their exemption in the Register of Exempt Persons.
Register of Exempt Persons
Overview
A person or business engaging in electricity activities may be exempt from needing a licence or trial waiver if there are special circumstances or arrangements that warrant an exemption.
It is a condition of some exemptions that the person carrying out the activity is registered in the Register of Exempt Persons in respect of that activity.
Victorian legislation requires the commission to establish a public register of exempt persons who are obligated to register with the commission as a condition of their exemption. See section 33C of the Electricity Industry Act 2000.
General Exemption Order 2022 exemptions
Some activities covered by the General Exemption Order 2022 (GEO 2022) require exempt persons to be registered in the Register of Exempt Persons in respect of that activity.
The Register of Exempt Persons is the commission's public register of all currently and historically registered exempt persons under the GEO 2022.
Other Order in Council exemptions
Under section 17(1) of the Electricity Industry Act 2000, the Governor in Council may by Order in Council published in the Government Gazette exempt a person from the requirement to obtain a licence in respect of the activity specified in the Order in Council.
