In May 2005 the Commission issued the interim operating procedure – compensation for wrongful disconnection, to take effect from 1 June 2005. This procedure was designed to assist retailers and the Energy and Water Ombudsman (Victoria) (EWOV) to satisfy the obligations on retailers to make payments to customers under section 40B of the Electricity Industry Act 2000 or section 48A of the Gas Industry Act 2001. At the time, the Commission foreshadowed that it intended to conduct a review of the procedure within six months of its original issue, taking into account the views and experiences of EWOV, retailers and customer representatives arising from the practical application of the procedure to date. On 8 August 2006, the Commission released the operating procedure.
