The Commission proposes to amend : clause 8.1 of the Energy Retail Code. This clause relates to refundable advances; clause 31(c) of the Energy Retail Code, which specifies the costs that retailers can include in early termination fees. The draft decision below sets out the Commission's reasons for making the amendments to these clauses. The Commission has also released a supplementary report on retailers' compliance with the early termination fee requirements of the Energy Retail Code, which supports the Commission's proposed amendment to clause 31(c) of the Energy Retail Code.The Commission has identified other minor drafting amendments to the Energy Retail Code due to changes to the Electricity Industry Act 2000 and the Gas Industry Act 2001, and the introduction of new national rules in the transition to the Australian Energy Market Operator. These minor drafting amendments are marked up in the Draft Energy Retail Code below.
