The Rail Management Act 1996 (RMA) sets out an access regime that requires Metro to have in place, at all times, an access arrangement which sets out the terms and conditions and process by which access to the rail network may be obtained. Metro is the access provider and operator of the metropolitan rail network and provides access to freight operators in return for a fee (an access price) so that freight operators can use the rail network to provide a freight haulage service.
In making its final decision, the Commission has taken into account the matters it is required to as outlined in Section 38ZI of the RMA. The legislation provides that where revisions have been submitted by Metro, the Commission must be satisfied that the revisions address the matters specified in the RMA. Where the Commission is not satisfied, the legislation provides that the Commission must not approve the proposed access arrangement, and must make the access arrangement itself.
The Commission has therefore made the access arrangement for Metro. The access arrangement includes the Commission's determined access price path as well as the non-price amendments.
