The Electricity Industry Act 2000 and the Gas Industry Act 2001 require all electricity and gas generators, distributors and retailers operating in Victoria to be licensed by the Essential Services Commission, or be exempted under an Order in Council.
The Commission may grant or refuse to grant a licence for any reason it considers appropriate having regard to its objectives under the Electricity Industry Act 2000 and the Essential Services Commission Act 2001, including the technical capacity and financial viability of the applicant.
Licences issued by the Commission are listed here, along with certificates of opinion from the Commission about electricity networks claiming exemption. On 1 July 2011, the Commission ceased issuing such certificates of opinion.
